Personal experience relating to providing legal advice to companies from outside the EU that want to introduce their products in the EU will be presented. As COTS products are “products” they have particular legal implications when sold in the European software market. In 2001 as a member of the European Commercial of the Shelf (COTS) User Working Group (ECUA) a series of meetings were held where the legal aspects related to COTS were addressed and discussed as well as the common problems faced by COTS users. As one can imagine it is extremely complicated to find a single solution for all legal problems, because the regulation is general and nationally developed for each Member State in the EU. But the tendency is that national regulations are being harmonized, so that in the future there will be an easier approach to this issue. | ||||||||||
